What can the CSA do to me?

Hi peeps, Im new to this forum but I need some advice, I am an NRP who has always taken care of my daughter who is now 23 both financially and morally. When my daughter was 9, myself and the PWC split up and we decided to come to a private arrangement, however the CSA became involved when she went on benefits. So I filled out the MEF and i had to pay £90 a week.

In 2001 I was made unemployed, so I contacted the CSA to inform them of this and could they re-assess me as I'm now signing on, I was told by the CSA that I don't need to worry AND WHEN I GET A NEW JOB THEN I MUST INFORM THEM. In 2005 I started working again and the PWC said could I pay her direct as when I was paying the CSA before she was not receiving any of the money, I said OK.

In 2009 I got a letter from the CSA saying I owe them £35000 and I have seven days to pay, so I contacted Nacsa who said I should get my DP files, I looked through them and it stated that I was still assessed on £90 a week from 2001 -2008 even though I was unemployed from 2002 -2005

Within three weeks of getting this letter I was offered a job in Dubai which I took as there were no jobs for me in the UK, I told the CSA of my job offer and change in circumstance and new address in Dubai, but I never once got any correspondence at all.

In 2011 I came back to the UK and the PWC told me that the CSA had written to her saying that a liability order was now in place and if they knew where I was, she told them Dubai.

The current situation that I'm back now and that I'm homeless as I stay with friends and family, no assets, no income, no job, not receipt of benefits, in fact I live on handouts from friends and family, no driving license, no valid passport in fact I have nothing apart from the shirt on my back, I contacted the CSA today to tell them i can pay them £1 a week and laughed me off the phone.

What I want to find out today is the CSA want a correspondence address and I cant give them one, that's one of the stipulations of me staying at my friends and families houses, can I use a PO Box?

If a committal hearing arises, how will I find out about it?

And if a committal hearing does take place what are the options the judge has to take out on me?

    Short answer, yes you can

    If a committal hearing arises, how will I find out about it?
    They will write to the correspondance address that you give to them

    And if a committal hearing does take place what are the options the judge has to take out on me?
    You will be given opportunity to explain your situation to the judge and he/she will make a decision accordingly
    However if the csa are just applying for a liability order which effectively pins the debt to you and makes it legally enforceable, then the judge normally just nods it through

    Raise a complaint ASAP about this, if you notified them, then the assessment is incorrect, if it is incorrect then the liability order already granted is incorrect.

    When you notified them of your moving to Dubai did you give them your current address? If you did, then they should have held that on file and had an address for you to be notified of the LO and as you had notified them then you may find that the LO has no legal standing, this is also something you need to put in your complaint, you also need to try and get hold of a copy of the LO and try to get it appealed through the court, if you can prove you had notified them of the move and that they had your address, then they should be able to overturn it and get it quashed.

    This does not remove the debt, just the legal standing of it. And means they have to start again, and you would have the opportunity to attend, if you can prove you had paid her in the period you where working, then it is possible that you have fulfilled your legal obligation for child support to your child.

    It is not upto them to decide what the outcome is it will be the appeal and after that ICE.

    But you need to do it all and not bury your head in the sand, this debt won't just go away. Unfortunately most of the debt they will be claiming is to the SOS so it is a government debt. If you have paid direct there is a chance they will go after your ex for benefit fraud, for not declaring, it is hard to know what to do, but you have to think of yourself, you have already paid once, why should you pay again.

    So what happened to the tax free money you earned in Dubai? Ex-pat jobs in the UAE come with accommodation allowances, so you should have been quids in.
