Sounds an obvious question but....

should I be in arrears with my creditor payments when I apply for bankruptcy?

At the moment I am having to wait until my stupid employers sort out my payrise before I can afford to put my petition in, and I have only missed one months payments. Due to an enforced house move (previous landlords did not have planning permission for me to live there, so council demanded that they gave me notice) I know I cannot afford my agreed reduced payments even with my payrise?

As I was in an agreement with my creditors to pay reduced monthly amounts (CAB helped me with this) they are now pressing me to revise my agreements, which I dont really want to do as I know I am going to apply for bankruptcy? My payrise (which will give me the £700 bankruptcy fee) will be in my bank account on 30th April, so I will be making an appointment to put my petition in on that day or as near as possible after then!

Not quite sure how to proceed, should I keep stalling/ignoring my creditors? Or fobbing them off, and if so how?

    Some Posters on here have gone BR with out defaulting on their repayment arrangements and others haven't paid anything for years. So it doesn't really matter either way.

    I would stop paying anything and use the money saved towards your BR fees. As for what you say when you are contacted you have several options.

    A) You just say that you are talking to the CAB about your situation and someone will be in touch shortly (the OR but you don't need to tell them that :) )

    B) you can just not answer the phone and let them just leave messages which you delete.

    C) you answer the phone, go through the security questions but before they can badger you you say "sorry there is someone at the door, be right back" . Put the phone down and go and have a coffee and put your feet up for half hour. Betcha they are not there when you get back to the phone :D

    Have you taken advice about going BR from anyone? You need to make sure you do or your BR may be delayed until you have.

  • Thanks for the advice and suggestions, especially about what to say to my creditors :T

    Yes, the CAB recommended bankruptcy to me as their first choice for me but I was optimistic (or stupid) enough to hope I would get a decent paid job and would be able to resume my normal full repayments to my creditors?

    Actually I suppose not that optimistic, if I had not had my enforced house move and had been in my present job I could have done that, but the way things have worked out it is never going to happen :(
