Advice needed please

I hope Im in the right place and I hope someone can help, Ill try and make it as brief as possible.

My Husband works as a coach driver, he has been off work sick since Jan and has been getting SSP from his employer, his GP has stated on his sick note that he can do other work for the company but cannot drive as he is being investigated for heart problems, the company stated that driving is his job and they have no other work for him, so that was that.

On the 12th March my Husband said he was ready to return to work as the tests he had proved he had no heart problems but the pain he has is due to either gall bladder or liver, and they are still investigating this, any way he told his employer he would return to work on the 19th March, She told him he couldnt do this as his sick note didnt end untill the 26th March and unless he got a note from his Doctor saying he was fit for work he couldnt return.

He had been for an abdominal scan and was told to go to his GP to get the results, he couldnt get an appointment untill this Friday (23rd March) and would then pick up a note saying he was fit for work again, he assumes he would get one as the trouble wasnt his heart, he still had one more weeks sick pay as it doesnt run out untill the 26th.

Today he recieved a letter from his employer stating that they are annoyed because he told them he would be returning to work on the 19th and never showed up, and as he had told them he was no longer sick he wont be recieving any sick pay this week, he as quite angry at this because its true he did say he was prepared to return to work on the 19th but it was his boss who refused this because of his sick note not ending untill the 26th, but now they are denying saying this!

If he doesnt get his sick pay tomorrow we are basicaly screwed, we have no money apart from that and its only £94 a week as it is, is there anything he can do about this?
not all on benefits are scroungers and don't need to be bullied!

    He this in writting that they didn't want him back till the note run out?

    Has he called his company and asked to speak to the stupid one who told him incorrect information? I would explain what you have told us to them and say its unacceptable to say one thing and mean another. Thats why companies follow proceedures after all.
    If he has been given the wrong information from one person then that person needs to be held accountable for it and the matter resolved quickly and painlessly and the correct money paid.

    Fight your corner. Your husband has done nothing wrong.

    Thanks for the replies, no he hasnt got anything in writing to state they didnt want him back untill his sick note runs out, he was just told over the phone, he isnt going to leave it and will complain to who ever he can if they dont pay him, they are a small family run company and a few months ago were making redundancies, they didnt want my husband to go due to the fact that he has been there for 12 years so they would have to pay him a few grand redundancy money.

    So I think now they are making it so hard for him, and doing what they can to make him leave off his own back, they have given him the worst jobs of the lot, they dont speak to him at all, its so bad he has lunch on his coach rather than sit in the tea room with the others, and now this just seems like a good excuse for them to get rid of him, they have said in a letter that because he has been off for 2 months he will now have to undertake a return to work interview, if they decide he is no longer suitable due to being off for so long they will have the excuse to sack him I guess.

    Please don't worry about the return to work interview, this is standard and most companies do this even for just one day's absence.

    The absolute best thing that can be done here is just to call them and explain the situation. Best to be as willing and helpful as possible as they sound a bit stupid really!

    Whether or not they told him he couldn't work then if he has a sick note from his Dr they really can't argue the fact that he was sick.
