County Court Pack

Today I got a county court pack through the door. Ups are taking me to court for unpaid invoices.

The claim is made against me as a sole trader

The reason the invoices were not paid is they damaged alot of my goods (wooden pet houses)

Claims were put in and nothing was ever done so we switched in the end and refused to pay these invoices.

The amount of stuff I had to chuch away was more than the £600 they are after.

Now it has date of service 23rd march on the letter and the court is miles away what do you think my best course of action is?

    I believe somewhere on the form you can ask for the hearing to be transferred to your local court?

    Presumably you have details of everything you had to throw away, do you have any evidence of the damage (photos or similar)?
    Do you have details/copies of the disputes you raised with them at the time?

    You will need to issue a counter claim for the damages.

  • When we moved out of our unit I did not have anywhere to store the goods so skipped them all. I did have photos but they were all deleted as this was over a year ago now. Bit stupid of me...

    So you have no evidence of this damage and you signed for all the goods ?
    If that is the case.
    UPS will win the CCJ.

    If you have no proof it would certainly be harder to try to defend against the CCJ. You could try to or you could decide to admit the debt on the form.

    If you try and fail will you be in a position to pay off the CCJ within 1month? if so then at least it won't appear on your credit history or the national register of CCJs.

    Another option you may want to consider - is trying to agree a settlement with UPS now for a lower amount?
