Bankruptcy and PPI claiming

Hi all

I have been looking to find a thread that answers my question but although some are close the threads I found were a year ago and the PPI situation has changed a bit since then...

I hope someone can help me with this one:

I was made bankrupt just over 5 years ago and discharged 10 months after.

My first question is how long does 'bankruptcy' hang over your head?
Some places say 5 years and others 7 years.

All I know from my receivers is that I would not be pursued after the discharge because I had two young children and only worked part-time and since my debt was the minimum I would probably never be made to pay anything back unless I got a seriously well paid job. I still have not heard anything from my debtors since.

So a couple of years ago I claimed bank charges from N*twest and was paid out. I did think the receivers might come after me for the £800+ but I never heard a thing although it was the account I included in the bankruptcy.

Now I am thinking of making a PPI claim based on my success with the bank charges and if I am now free of the bankruptcy after 5 years I can't see why I can't claim?

After all the reason I went bankrupt was because my husband left me with the debts and when I tried to claim on the PPI I was refused because I only worked part-time so when I couldn't make the payments I finally caved and went bankrupt.

The reality is I was paying for insurance I couldn't use when I needed it! :mad:

I guess I am asking if anyone else has had any success with a similar claim or has the professional knowledge to tell me whether I can claim the PPI back or not?

    The infomation provided is on the basis that you live in England or Wales, the rules are slightly different in Scotland (Please let us know if you live north of the border!)

    If you were to succeed in a PPI claim the money would need to go to your Trustee. This is due to the fact that insurance was in relation to credit agreements that you took out prior to the bankruptcy date.

    You would have a duty to inform your trustee of the potential claim for compensation and the right to make a claim will automatically vest with them. As the banrkuptcy order has been made, you no longer have the right to pursue the claim.
