Giving Notice, Advice Needed Asap Please

Hi All
I would like some advice please. I am currently in a full time I dont like. I got a phone call Friday teatime offering me a new job in the town I live. The hours are what I want which is nights and the pay is much better than what I get now. The company I work at now is awful to work for, the staff are treat very poorly and so many have just walked out in the two years I have been there.

The question I have is this, the new job I have been offered starts a week tomorrow but in my contract at work it says I have to give two weeks notice. I would like to know can I ask to have my contract terminated with immeidate effect? At least five people have just walked out in the time I have been at the company and have been paid for the hours they had worked but I would like to try and leave in a better light than just walking out.

Any advice would be great and thank you

    Could you ask the new job people if you can start a week later.

    Other than that you could just bluff it out and leave next Friday
    (giving 1 weeks notice) They could in effect sue you but lots of people say it is unlikely but possible. This would be for any exta costs involved in covering your last week.
    Some employment law people will be along to help but you must put your notice in first thing in the morning, I think it should have been, by rights, put in on Friday.

  • Yeah im handing my notice in first thing in the morning. Will see what happens. At the end of the day I have to do what is best for my partner and my little boy.
    The employer needs me to start asap due to the current work load.

  • Well this is it Generaloneill. I just want to leave ASAP and I think im right in saying by law they have to pay me up for the hours ive worked upto leaving.

    any holiday pay left to take? Maybe if you have 5 days or something this can go towards your notice.

    If you were to leave early you will be in breach of your contract and your employer is allowed to sue you for damages IF they can prove mitigating loss. Your ex-employer will also be allowed to write on any requested reference that you breached the contracted terms which sounds a lot worse then it is but can look very bad.

    But that majority of the time everything works out OK.

    Has anyone left giving notice?

    Were they asked to work it.

    going out not burning bridges is good if you can.

    think is if you give 2 weeks and they ask you to fiish early they still need to pay the full notice.

    give them chance to do that first, then try to negotiate leaving early unpaid, holidays.

    Try to get the start date pushed back, I would alway be wary of an employer that is happy for you to stitch up a previous employer, good sign they will be happy to do the same to you.

    Word of caution - you don't have a new job at the moment, you had a phone call, that's all. Until you have something in writing then it may easily be withdrawn (there are such stories on here). Do they need to check references? If you want one (now or in the future) from your current employer, then best not to annoy them.

    I'd take the route of talking to the employer, something along the lines of 'I realise I should give two weeks notice, but they want me next week, can I go on Friday?' They may say yes, you never know!

    But don't do it until you have something in writing!

    Absolutely agree with Wyndham. Lots of people have been caught out like this by handing in their notice and then the job offer being withdrawn. You then have to "eat humble pie" and hope your current employer will let you withdraw your notice or you end up with no job.
