  • Okay, so should I make it clear to them that if they intend to sell this debt onto another DCA, they will be in breach of OFT regs, or potentially let them hang themselves? :D

    I'm going to fight this. No evidence = No cash!
  • Received a letter from Freds today:

    We write with regard to the complaint you have made and enclose a copy of our Complaints Procedure.

    We confirm that we are currently investigating this matter and will revert to you with a more substantive response as soon as possible.

    In the meantime we confirm that the account has been placed on hold until further notice.

    Sounds like I managed to get through to them. If they don't drop it, I'll go to the OFT.

  • Further update:

    Had a letter from Freds yesterday...

    'We write further to our letter to you of 5 April 2012.

    We confirm that our agreement with our client is that all requests for documentation from customers need to be made direct to them. We are sorry but if you still require documentation from our client you should request this direct from them at the below address:

    We have referred this matter to our client and they have advised that you failed their security questions on the telephone to them. If you believe this account to have been fraudulently opened then please contact them direct either by telephone at: or at the below address:

    We have investigated your complaint and all of our actions are compliant with legislative and regulatory requirements and we do not consider that it is appropriate to pay you compensation.

    We have placed the account on hold to allow you time to contact our client and accordingly we look forward to hearing from you or our client in due course.
    This is a final response and if you remain dissatisfied, you may refer your complaint to the Financial Ombudsman Service and if that is your intention you must do so within the next six months.'

    So at this point I'm not sure what to do. I don't buy this idea that I have to chase Capital One to prove my innocence. If Freds are chasing me for money then they should be the ones providing evidence to support their claim, surely? And as it does say in the OFT guidelines, DCAs should be able to provide documented evidence when requested.

    Any thoughts or opinions on my next step?
  • I to have been having the exact same issue with this company (Fredrick International).

    I have sent them a Prove it letter, there reply was to contact Arrow Global Guernsey Limited, because the debt is linked to a catalogue, called Choice.

    As you can imagine, I have never had a catalogue nor have I ever had a contract or account with Global.

    What happened after the the last letter you received in March 2012?
