Capquest/Capital One

Hi all, I'm new here so bear with me.

I had been on a payment plan with Capquest over a Capital One credit card debt of (at the time) about 1k. I was on the plan for quite a while, then when I lost my job, I couldn't meet the agreed payments, and so I received a letter saying that "litigation was necessary" to resolve the account. The same letter stated that if I paid £438.67 (at the time the debt was £860.15) then the account would be settled with a "partial settlement flag" on my credit file.

My parents agree to help me out with this figure, so I jumped at the chance. The account was paid off the same day, roughly a month ago, and closed with Capquest. I received a letter from Capquest stating that the "full and final" payment was the aforementioned £438.68. All conditions that they had (amount, number of installments and date of payment) were all met, so no problems there.

Fast forward to this morning, after not hearing anything from Capquest or Capital One for a few weeks, I received a letter through the post stating that, and I quote verbatim here:

"Your account is no longer being managed by the Debt Collection Agency who were acting on behalf of Capital One. Your account has now been returned to Capital One. It is important that you continue to make payments to your account. Payments should be made directly to Capital One unless otherwise noted."

I did a quick sum, and found out that the figure that Capital One claim I still owe them is the exact amount left over after paying the settlement figure to Capquest; £421.47. Funny how it happened to be that huh

Now, to the root of my problem/question: as I was informed by Capquest that "the above stated settlement figure (£438.68) will be accepted in full and final payment of this account" can Capital One chase me up for this extra money, or is it just a case of them trying to strong-arm me into paying extra money?

  • i had the same problem with both these companies and it took me months to get it sorted. Speak to a manager at capital one, email over the copy of f&f and they should accept it

  • Thanks Hadahardyear. I spoke to them earlier, and they gave me some nonsense about having to send a request to another department which would take 7-10 days, however Capquest said that the account was closed at their end. I will call monday and sort it
  • luckily i had kept a letter form capquest confirming the account was closed, otherwise i wouldnt have had a hope in hell. make sure you keep everything you have
