advice for friend from A2 country and national insurance number

Hi my from is from Romania, he has been here 8 months working but tells me he cant get a NINO, he plans on staying. How can he get one please? any advice?

    If he is working for an employer, to obtain a NINO he needs to have a work permit, without one he isn't entitled to work for an employer and if he is, then he is working illegally.

    If he is self employed he doesn't require a work permit but for a NINO he needs to provide sufficient evidence that he is actually self employed and not just (for example) a self employed cleaner who cleans all of his mates houses. His 'clients' will probably be contacted and asked some questions about what he does, how he came to be doing work for them, how they pay him, etc. It has become much more difficult to obtain a NINO for an A2 national who claims they are self employed.

    The best advice is to apply for a work permit (if he doesn't have one) and then he can work legitimately for anyone and then obtain a NINO without any problem.

    Of course, if he is a student or family member to a UK national or another EU national then he may be exempt from having to provide this information but for a NINO he needs to provide proof of his student status or the family connection.

    He should check the DWP and Border Agency websites under rules for A2 nationals.

    Did he take his original work permit, proving his right to work, with him to the interview? If he did then I find it strange that he was told he could not have a NINO, but maybe he's not telling you the whole story?

    In any case, the interviewers aren't the decision makers, they just complete the form and copy all documents and send them to the offices that make the decision. Is he working for an employer?

    If he has a valid work permit then I suggest he makes another appointment for a NINO interview and takes his work permit, ID docs and proof of employment with him.

    If he is in employment a work permit isn't sufficient for an A2 national. He also needs an A2 card, without which he is working illegally, and he can be fined £1000 - his employer £5000. It is actually very difficult for an A2 national to work legally in the UK unless he is self-employed and can evidence this. Rules on A2 citizens were designed specifcially to prevent them easily entering the jobs market in Europe.
