Employment Contract

My girlfriend started a job in January, but hasn't had a contract yet. Whenever she asks about it they give some reason about why it hasn't been done yet.

Anyway we're not really sure what it means to not have a contract and we're beginning to worry about why they haven't done it yet. The question I have is really what sort of problems could be lurking ahead, or is it nothing to worry about?

    She has a contract, perhaps she's referring to a written statement of particulars?

    Basically if there is no written particulars then she wants to take the statutory ones as minimum and observe if the company offer more than this.

    But be aware that anytime in the first 12 months (inc stat notice) that she could be dismissed with no come back unless its been done for a protected characteristic..ie sex, race etc)

    She has no lawful right to a contract. She does have a lawful right to a written statement of particulars (job title, hours, pay, leave) within 12 weeks of working. However, in practice there is little she can do if she doesn't get it.

    Regardless, a contract 'exists' in that she goes to work and they pay her for it. So whatever the company's terms and conditions are - policies, processes etc - they form part of that contract.

    I'd still ask for the written statement, though, if she doesn't get it within the first three months.
