A few Questions...

Hi All,
I just wondered if I could ask a few questions that hopefully, someone might be able to help me with...
Last week I had an appointment with the CCCS and was advised to apply for bankruptcy.
I have the forms and have spoken to the court, need to phone back to book my court appointment. But I have some things that are bothering and worrying me.
The IPA- how is this information determined? What I am finding hard to grasp is how much (or little) they take your partners income and contributions into consideration. It is just me going bankrupt. The debts are all in my name. I understand that my husbands income will be on my SOA because he works and I don't (I did when I took out the original credit accounts). But what about bank statements etc? Will the OR want to look at his as well as mine?
And, when looking at a IPA-will they take his surplus into consideration? He doesn't have a lot of surplus at all, but myself alone I don't really have any. My only income is child benefit, child tax credit and my carers allowance for our disabled child. I also get DLA for our disabled daughter-but obviously this is used for her and the things she needs because of her condition.

If your income is solely derived from benefits then you will not get an IPA.:pB&SC No. 298

Do they have the right to look at dh's finances as well as my own?0 -
If its only you going bankrupt then all the OR needs to know is how much your partners contributes to household budget, which I guess would probably be 100% if you're not earning.
I was similarly on a very low income from being self-employed & had no problem with this when the soa was gone through in the interview

It was only me going BR, all debts in my name (and my husband knew nothing about them until then), and I was/am only on benefit (well, only child benefit), and you dont disclose your OH income, just what he contributes ie 100%.
My husband has never had to supply income, bank statements etc, as he is financially independant of my mess!

So, when I fill in the SOA do I write all the amounts of our rent, household bills etc even though I don't pay them?
