Hi my niece's DS is broken but is still under warranty. However since Game is now in the red does this mean we can't get it fixed?

They are still in business, struggling yes but still going. Should be no probelm getting it fixed. In any case, your first years warranty on the DS is with the manufacturer, not the retailer. If you took out an extended warranty, although you bought this thru a retailer, the policy is underwritten by an insurer and it would be these you contact if the retailer goes under. All such details will be on the documentation.
At the moment though, there should be no problem taking it in for a repair.

If you have to have it repaired under warranty (i.e. Game doesn't do it for you), then Nintendo's repair process is straightforward.
If it comes to that, you will probably need proof of purchase for the warranty.
