Denied Union representation at a disciplinary hearing.

A family member has a disciplinary hearing at work soon, they received this in writing and in the letter it said they were entitled to Trade Union representation.
After informing their employer that they intended to bring a Union Rep they were told that they were not allowed as the company does not recognize any union, that they have made it worse and were offered a manager as a companion. Can the company do this? Any help would be much appreciated, thanks.

    Er, what kind of joker organisation says in a letter they are entitled to TU rep and then says they don't recognise any? Unless they just copied someone elses HR policies :cool:

    In short no they cannot refuse a trade union representation if it is a disciplinary.
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

    ^^ This. And to add: the company doesn't NEED to recognise any Trades Union for employees to be members of them. So the fact that they are unrecognised is totally irrelevant.

    It is unlawful to not allow TU representation at a disciplinary hearing. (This is not the same as an investigation meeting.)
