car finance companies

my daughters car finance company, have been charging her for late payments (2or3 days,and are supposed to be direct debits) at £25 a time, plus charges for letters etc. can she claim these charges back in the same way as you can claim bank charges back?? . would appreciate any info .

    Yes - they are penalty charges.

    Particularly if it is their mistake then the charges should be refunded in full.

    If the direct debits have been bouncing then she could be liable to a penalty, but only the admin costs associated with resolving the situation. An automatic letter does not cost £25!

    If they are charging the £25 and charging for letters then they are certainly on thin ice.

    If you really want to push it, they probably won't want to go to court and will refund in full without having to defend their current charges in front of a Judge.
