Help needed with Appeal ?!?!?!

:confused: We received a letter saying that we will get a date for our appeal against our council tax banding. It is outwith the 6 months (8 years infact) so I don't feel too confidante. Has anyone else appealed outside the six months and won their case - we live in Scotland is it different rules here? Sorry I feel so niave.

  • Hi I live in kent and am in the process of trying to get our banding lowered too. They rejected our online appeal as we did not fit the criteria (we have lived in the property since 98) so they said they would look into it, but decided there wasnt enough evidence to change it, so they have said it must go to tribunal. I have to say I am a bit worried as it sounds so formal and I too am wondering if we will have any luck. Do we have to go to the hearing or is it behind closed doors?
  • Not sure if it is the same procedure north and south of the border, but if we had had to go to the tribunal ( Scotland) we would have had to submit written evidence supporting our claim to both the Valuer and the Tribunal. We could also attend in person to answer any questions they had.

    Luckily they accepted our appeal. We were within the 6 months.

    From what I can gather we have to attend the Tribunal. I just really need to know what to say in support of us not doing it within 6 months.
  • Me Too! Somebody else must have been through a tribunal!
  • Justifying not doing it within the 6 months is tricky.

    Why did you not do it? That may be a starting point.
  • I have been paying Band F in my current home for almost 10 years and have just been rebanded to Band E.

    There is a 6 months limit from the date you move in for Appeals but you can request a review at any time.

    Please don't ask me what the difference is - I've not got a clue and I don't care as I am about to get a cheque for £2k.

    This is what I did:

    Use the houseprice calculator to find the value of your house at Quarter 2 in 1991 - http://www.nationwide.co.uk/hpi/

    Check the suggested banding against Tax Bands on your Council website.

    If you think you have a case:

    Fill out the form online with you basic details - request correspondence by email as its much quicker - https://www.voa.gov.uk

    Once you get the standard email saying you cannot appeal.

    Email back saying you want a REVIEW and have checked your valuation with the nationwide calculator and in 1991 your house was worth £X which should have placed it Band ?? You can also check what your neighbours are paying and use these as comparisons if it benefits you.

    Then ring you local Valuation Office and tell them you would like a review giving the same reasons as above. They will ask a few questions, how many bedrooms, bathrooms etc etc and will put you forward for a review.

    That's it. No fees, no fuss and mine took 4 weeks to complete.

    REMEMBER: If you have been there more than 6 months you are not Appealing you are asking for a REVIEW.

    Apologies to the OP - I don't know the procedure for Scotland but it must be similar I would have thought.

    My neighbours got their house rebanded and the family have lived there for nearly 100 years.:D

    Maybe you could got to the tribunal and say you saw a program on telly and now you want to appeal im sure theyll find that reasonable lol

    Nah as above ask for it to be reveiwed you can do this after your 6 months is up.
