    If you could be clear about this OP and tell us what the gross misconduct was that you were dismissed. What was their reason for dismissing you. I dont want to know whether they did this or that. For now, just mention the reasons why they dismissed you.
  • 95% of gross misconduct dismissals are because the individual has done something stupid or silly - because it is stupid/silly to steal, behave in an inappropriate manner, break rules that the rest of the employee population comply to...

    Now it maybe that your employer had behaved appallingly and broken every rule in the book - but just in case - just remember nice people, good people, who break serious rules, get sacked. Good/nice people steal when they are desperate, fail to follow important procedures when they are disengaged or do absolutely out of character, stupid things like run up £1000 company phone bills voting for X factor or drive a company car when drunk.

    They'll never do it again, there's always a reason and almost always they are stressed either from work or personal issues. But ultimately they get sacked as their employer can no longer trust them and they've breached their contract. Employers are not parents - not many give second chances when the issue is serious.

    It's awful to be dismissed, I'm sure you feel angry and upset - but ultimately a dismissal can be fair in law, even if it is not by your standards - and if it is, then no amount of mitigating circumstances is going to win you a tribunal.
