Bankruptcy Court Date - do I have to attend?

I have received my date for bankruptcy hearing and I am not contesting it - do I have to attend the hearing?

No, you don't have to attend.

If you don't contest it, and want it to go ahead, it might be a good idea to write to the court saying that you wish the bankruptcy order to be made. That way the judge will have no doubt on how to proceed on the day.

Thank you. Couple more questions - what happens after the court date? When does the OR become involved and who appoints the OR? When should I open the Co-op cash account? sorry for so many questions

Hi Emerald 1966, I petitioned for my own BR so don't feel qualified to answer your first two questions. Hopefully someone will answer those for you soon.

As far as your Co Op a/c goes, I would give them a call and set it up as soon as possible - they're very helpful, you will then be able to set up any DDs in plenty of time for payments to go out and things will be a lot smoother for you.

Just to let folks know, I didn't go to the court on the day and it didn't make any difference. However, I did contact the clerks office in the bankruptcy department and spoke to a very helpful clerk who recommended that I put in writing to the court that I was not contesting the petition and that I would not be attending which I did. The petition went through and I was contacted by the OR within a couple of days. Thanks for all your advice and support.
