Agency work, refusing the pay, refusing to provide info and more

Hello folks,

I have been working in a warehouse, only 20 hours a week and my weekly wages paid by the agency instead of the company. However due to some personal legal and health issues I could not go to work for two days and I was dismissed. Of course, I understand, It was my fault.

Agency told me that I need to return my locker key and the entry pass then they will pay me for the last days i have worked. They told me that £9.99 will be deducted because "I was dismissed within 12 weeks and I do not have the viz jacket that they provided for me"

But £9.99 was for the jacket and I had the jacket in the company closet, I could possibly recover it, or purchase a new one and return it. However they have never asked me about it, and where did this 12 weeks come from, I didn't know about this penalty? They have just deducted this money, ignoring my questions and being very rude, accusing me that I could not keep up with the job. I still don't know why this £9.99 was charged, I could return the jacket... anyway

I have returned they keys, they have received it next day (Thursday) but they did not pay me on Friday as i was expecting my final wages to be sorted on payroll day. Saturday I have received a "blank payslip" with a note on it "Still waiting for the keys". But the hours I have worked and the rest of the info was not there. It was simply blank... After a week, next Friday they payed me £24 pounds for 1 day - into my old bank account!!!, which was my last day, but they are still ignoring the previous week i have worked (blank payslip) in total 12 hours I have worked.

I have emailed their manager and asked:

- I have worked these dates xxxx and received no payments and received a blank payslip. When will i get my money
- I never received my first week payslip, can you provide this.
- Paydays were always wrong on the payslips, doesn't match with my bank records. Should I be worried?
- Why did you deduct £9.99? Despite i can provide the jacket. Why there is a penalty for a dismissal within 12 weeks. So is this deduction for jacket or dismissal. I am very confused
- Why did you make a payment to my "Old bank account", I asked you to destroy that data while ago, because it was a joint acc. and it has something to do with my ex-wife. You have my bank info, i have been getting my wages in to that account but for some reason you sent that money to an acc that i have no access anymore and you were informed. You had to destroy that data. I cannot access that money. Is this a punishment for my dismissal?
- Since I was dismissed you are treating me unfairly with this punishing attitude, not answering my questions. Simply why?

I have just spent 1 hour of my valuable time reading through your lengthy emails to Lisa Kelly. Eren your pay is correct, AS&T work from a SAGE payroll. This is directly connected to the HMRC.
(I KNOW WHAT DAYS I HAVE WORKED CLEARLY, IT WAS TWO WEEKS AGO)

With regards to your comments about the charge for the high visibility waistcoat please refer to the attached. This is clear evidence that you informed your interviewer (Lisa Kelly) upon interview that this was a requirement. I have also attached your signed acceptance as evidence you were fully aware of the charge. I would appreciate if you would stop the constant accusations. (I HAVE THE DAMN JACKET, I CAN PROVIDE IT)

Following you comments regarding the type of work at FPS. You were made fully award of the position and your duties whilst at work upon interview. You were dismissed because of your continuous reduction in hours. This was never done. The work was not difficult and you were only contracted to work 20 hours per week???? (I AM WELL AWARE WHY I WAS DISMISSED, NEVER QUESTION THAT, THIS IS NOT AN ANSWER TO MY QUESTIONS, AND ARE YOU PUNISHING ME, WHAT IS THIS ATTITUDE)

Eren I recommend you have a serious think about your career moving forward. AS&T will not be contacting you for any further contracts moving forward. (WHAT? ALL THE THINGS I HAVE ASKED???)

I am really sorry for my lengthy post, I need your advices. I need every penny these days, due to financial and health issues, I got collapsed i am seeing my doctor now. Thats why i couldn't keep up with the job. What can I do to protect my right, recover my money. I don't even know where to go. What do you see when you look at these things above. Is there anything I can do against these people. Are they acting unlawfully, I don't understand these things. Id appreciate if you enlighten me

    So if this is the case they can deduct the money

    What hours have you been paid for? Write a list of the hours worked and when you got paid and see if there is one missing.

    They have to prove then to you that you were in fact paid and provide dates for all the payments you think you were expecting.

    If you still say you are owed £ then you can take them to tribunal

    And I can send him a brand new jacket, he is ignoring my offer as well. nOrmally he had to ask me if i have it or not... He just straight deducted the money

    How can they provie you with a blank payayslip? Just ask the payroll dept what the blank slip was for?

    Is there anything on it at all like zeros?

    Date is bizarre on it, there is a huge gap between what its supposed to be and what it is on the paper.

    and there is a handwriting: Waiting for the keys...

    They are basically pretending like i haven't worked that week. I again asked him, still not answering..

    could it be you wont get paid till they have the keys?

    As i mention above, they got the keys two weeks ago.... They confirmed they have them...

    so then you go back to them and ask when you will be expecting the last pay and give them 14 days to pay it

    Ladymiss, i told him that im on my way to the warehouse to get a copy of my "days of attendance thing", and i have received it. I came back and check my email again.... wow he is twisting the words now....

Our client FPS Distribution required your entrance key & locker key. This has now been received and your pay will be processed this week and paid Friday 09.03.2012.[/FONT]
