    What I actually meant by 'winning' was getting the opponent to cave in early doors, not winning as in finding justice in the courts. Surely once it gets to court you are in something of a crap-shoot anyway, even if your case is pretty good?

    some opponents will not cave-in even if they know you have a very good case, which may influence of lawyer to say its not a strong case, because they are all too aware of the random element of the court room.

    What? You think that courts are random, but want a lawyer who can guarantee that an employer will "cave in"? And you think that lawyers decide what a strong case is on some arbitrary guess rather than on the law? You really have no idea what you are talking about.
