I work for a lender in complaints but they are all different. As far as I am aware, possession proceedings cannot start until you are two full months in arrears. They may send you lots of threatening letters but they cannot take you to court until your are a full 2 months in arrears. Your post above says that you are in arrears by one month but the SOA says different. Also if the SSAFA paid and you paid, do you still owe them this month? Have you asked them to put you on Interest only or if they won't, at least extend the term....There are times when parenthood seems nothing but feeding the mouth that bites you Peter De VriesDebt free by 40 (27/11/2016)0

Don't forget what I said about tax relief on CSA payments (It's all child maintenance payments I think), - ring your tax office and ask them.
In all fairness, as a produc of a broken home, I am inclined to agree that your kids should come before your mortgage.....but I'm willing to concede that everyones circumstances are different. The CSA will only change your payment if you or your ex ring them and report a change.0 -
Thankyou both
Mortgage - GMAC wants mortgage paid on 15th of each month but I only get paid at the end of the month ie 28th/31st. They are ok about this but until motgage is paid at the end of the month it looks as if we have more arrears than I should. GMAC still expect this months money they dont care that they have taken too much last month,
CSA- will try and get tax relief from CSA I'll talk to tax office on monday. I agree that my children come first but CAB say that it is mortgage 1st then other priority debts afterwards.

What is the actual position of the mortgage? For the two months, they should be expecting to get £595 x 2 plus £120 towards the arrears. Have they received this already or is there a shortfall. If you have agreed the £60 pm with them, they cannot be expecting to get more.....There are times when parenthood seems nothing but feeding the mouth that bites you Peter De VriesDebt free by 40 (27/11/2016)0

Re pay, ask the CAB about a possible claim in the small claims court. If the company is a PLC or limited company this may not work. There is something about stopping the company using their bank account till they pay you, can't remember the details perhaps someone else knows what I am frantically trying to remember.Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)0

Thanks for the recent help
Mortgage GMAC are expecting us to pay the normal mortgage £595 each month and then £60 extra each month to pay the 2 months arrears. They are asking for more than £60 extra but CAB have worked out SOA and said this is what we can afford. If my husband works extra weekends then may be we can pay slightly more
Thank you for the advice about the companys bank account. We thought about going to the small claims court but depends on cost as you can imagine money is tight at the moment. However as part of GMB they use a legal firm which is free to members so we might be able to do it through them
