CSA - why bother..?

I got a letter back from my MP and the Head of Client Services (Falkirk) today about my case - in short, why was I on CS1 when the PWC was linked to another NRP on CS2...

The highlight of the letter...

I can confirm that when we receive a new application against a second NRP, the old rules case is converted to our new rules system. Regrettably, in this case, we were unable to complete a calculation on the new case as the PWC withdrew the application before we could set an effective date on the new case. We were therefore unable to convert the first NRP's liability. Unless the PWC makes a further application in the near future, the first NRP's case will remain on the old scheme

What good reason could the PWC have for withdrawing the claim and as the PWC classed as being on benefit why did the CSA allow it..?

If I approach the PWC - can I get my dealings with the CSA dropped and pay her directly..?

The PWC must be on WTC/CTC which means she can indeed withdraw the 2nd application. Therefore you will have to remain on CS1.

Yes you can approach the PWC direct to reach a private agreement. If she agrees make sure you do receive a letter that states she has closed the case. Arrears will still stand however. The PWC will still want the arrears paid off. Perhaps you could both reach an agreement on this?

There is nothing stopping the PWC making a new claim after 13 weeks to the CSA if the agreement doesn't work out. I think the NRP can too! Then you would be on CS2.

Yes - but if I approach the PWC what implication will it have on her income if I pay directly...

She's listed as being on a benefit - but I don't know which...

It won't have any implication. She keeps the whole of the maintenance. If she was on IS the CSA would not have let her withdraw the application ( unless she has stated the other NRP is violent ).

You need to speak with her.
