phone calls started again!!

I'm in my 3rd month of a DMP with CCCS I originally had millions of phone calls but then they all stopped once my DMP was underway. Lloyds seem to be the only creditor not stopping interest or letters then last night a phone call asking for my dob which obviously I refused, said I was with CCCS gave the woman ( well actually she only sounded like she was a stroppy 13 yr old!) my CCCS number asked her NOT to call, she was very rude and snotty I pointed out I had been in touch with them both by phone and letter etc etc but she just kept repeating " you obviously dont want to sort this out"She said they dont deal with CCCS and that I should sort it out with her now, eventually I said I felt like this was harrassment but she said they would keep on calling several times a day until I spoke to them! What can they do? what should I do?How do I find out who they are?

  • Next time they call, advise them you are going to record the conversation and if they still hassle you after you have explained your CCCS situation to them then you could try reporting them to the financial governance people (name escapes me atm)

Or atleast someone higher up in the bank.

  • i had the same problem with Lloyds they were ring me at least 7 times a day and each time i told them them the same thing,in the end i asked to speak to a supervisior and told them that the constant calling was harrasment and that i would be recording any future calls and keeping a log of how many times they were calling and reporting them ,the calls then stopped.

    Re: Harassment by telephone

    Dear Sirs

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

I have verbally requested that these stop, I also made a formal request in writing and faxed and emailed it to yourselves, which you acknowledged and responded to, but I am still receiving calls. I have read receipts to prove these were received.I now require all communication from your company to be made in writing only. I also now require immediate written verification from your manager that my telephone number will be removed at once from your files. In your last letter to me you state you have no record of me on file. I ave had no further communicvation since then.

If you are of the opinion that I owe yourselves or a creditor any financial obligations please put this in writing immediately.

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I am now reporting you to OFCOM, Trading Standards and The Office of Fair Trading as you have completely shown contempt and disregard to my previous letter, meaning that you will be liable to a substantial fine.

Be advised that any further telephone calls from your company will be recorded.
I am sending copies of this letter to my solicitor and my MP now as well aas OFT and the I.C. as I feel that the sheer incompetence or blatant contempt of your company to follow basic communication needs to be highlighted.

I require that your manager only sends me express and clear clarification within the next 72 hours that my telephone number is removed from file.

I trust that this is now the end of this matter.
Any further calls will constitute in a formal letter from my solictor arriving to not only yourselves, but Chris Clark who appears to be my “account representative.”

    Yours faithfully,

    Michael McBirnie.
