Bailiff Removal Notice

Hi, I have been served with two removal notice tonight which I received when I returned home at 7pm. I have telephoned the bailiff to see if I can stop the action and have been informed that I am in arrears with my monthly payments, as far as I am concered these are now up to date and they have informed me that they will proceed to take goods in the morning at 6 am.

I am now living with my partner and the majority of goods in the property belong to him - can they take his items? when the walking possession was levied it was at my previous home on goods I no longer have. Can I protect my partners goods?

Can they force entry to my property in the morning?

Very stressed thanking anybody in advance for their help.

    Have the bailiffs produced an order from a court they claim to be serving ?

  • I havent actually seen the bailiff tonight and cant remember if they produced the order on their previous visit. sorry

    Did you sign the original walking posession order? did it detail your goods in a proper amount of detail? ie not vague things such as 'TV', 'Computer', but 'Samsung Widescreen TV'? Would it therefore be easy to demonstrate that the goods in this house are not the goods on the Walking possession document?

    In terms of whether they can force entry to a different property I'm not sure, hopefully someone experienced in this field may still be online and see your post.

    If not I would recommend reading the various pages and advice on the bailiffadviceonline website which may have some information that is useful (though I can't see anything about a different property).

  • Hi Tixy, they did write specific items on the walking possession - can they only take those items that were previously listed?

    they can only force entry in to the property listed on the order if they have been invited in before.

  • Hi Vax, they have addressed the removal notices to me at my new address - is this sufficient for them to force entry to this house? the debt is for different address which is where the walking possession was levied
