You've a good memory, DD. I think I said 'we might have won the battle but lost the war'. I'm not pleased to be proved right but I think there was an inevitability about it.

Yes, thats exactly what you said! - there would be better things to be proven right on, but you were spot on.

I know it's a bit late, but can someone please make clear the situation as it applies today. I was bankrupt in 2006 and i am getting letters for social funds etc from dwp for loans back in 2000/2001.

Are these loans (which i cannot remember at all) recoverable today or are they covered by my bankrupcy in 2006, so i can give a reply to dwp please can someone explain where i stand now.

    Thank you in advance.

im not able to answer because i don't know, however if you don't get the answer you need from the boards, try your OR's office. I'm sure they will help, the one in cardiff was very helpful when ive asked questions before.

    OR - official receiver

You have found the right thread on this. I haven't seen this one for many years but am apparently still subscribed to it!

Your bankruptcy covers those loans provided they were recoverable before the date of your bankruptcy.

The relevant legislation is in Fermi's very first link. Prior to this amendment they were not excluded debts.

So if my loan was in 2000/2001 and my bankruptcy was 2006 then i am covered by the bankruptcy and my loan is cleared?

Thank you FB, why do they still come after the debt and what about council tax? Does council tax be included also?

You're unlucky to still be being chased for so many debts 10 years after bankruptcy.

Let this thread be for social fund loans and start a new thread for your specific problems
