Urgent help needed

Hi everyone, just in need of some advice.

In 2007 my ex and I got a mortgage together. In jan 2010 she decided she didn't wanna be with me anymore, and I had to move out and rent somewhere. When it came to sorting the mortgage out I was happy to let it be repossessed as u already had other debts but she wanted to carry in living there, she tried getting a mortgage in her own name but couldn't and so we made an agreement that I would stay on the mortgage for the short term whilst she sorts something out. Anyways, 2 years down the line and she's living there with her new man, pregnant and I'm still on the mortgage. I've tried to ask her politely to sort it only to be met with a barrage of abuse and a refusal to do so on the basis she hasn't got a deposit, and she doesn't want her new man to go on mortgage, even though he isn't short of money and has a good job!

Is there anything I can do?

    Yes, its not your problem what she wants. Your problem is you being on the mortgage. Get a solicitor on it and they can force a sale, going to court if needs be.

    Is there any equity in the property?

    If it's worth (say) £80k but the mortgage is £100k, then the lender might be highly reluctant to allow you to walk away - sale or no sale.

    If it's the other way around, and the property is worth more than the outstanding mortgage, forcing a sale may help you.

    Can I also add that back in 2010 she had me sign a contract drawn up by a solicitor saying that im not able to receive any equity in the house should she decide to sell it. Also, I think the house is probably worth approx what the mortgage is.

    If those two statements are both true then it's absolutely in your interest to force a sale now, while there is no equity, and walk away to start a new life without liabilities.

    That was on the basis of a short term arrangement. The situation has obviously changed.
