Advice needed please..

My sister is divorced from her husband & the house is up for sale & has been for a year or so with no joy of selling it as yet.

My question is can my sister`s ex husband expect to get 40k (thats how much he wants) once the house is sold even though he has not contributed anything to any bills for the last 7 years?
He is starting to hassle her & has told her he will speak to the estate agent himself & tell them to drop the price so that he can still get his 40k. I have told her that he can`t do that but am i right?

Please can somebody help with some advice?

    Theres no where bear enough detail to answer accurately I'm afraid. As a minimum we would need to know what the house is going to sell for, what the mortgage is, and if the ex is named on the title deeds.

    Even then its not clear cut.

    Everyones situation is different, your sisters best option is to speak with a solicitor

    The house is up for 179,950. The mortgage is for £130,000 & yes he is on the deeds.

    Does it count that he has not contributed anything for the last 7 years (they have been split up for 3 years).

    Also she has no savings etc to afford a solicitor, would she be entitled to legal aid?

    I don't think she can afford not to have a solicitor

    Much will depend on what other assets there are, the starting point is 50/50 of the 'marital pot'
    If there is only the house to consider (no pensions or other assets) then with £50k equity the starting point would be £25k each.
    Do they have children? this could move the split in favour of the person with the children living with them
  • Why does he think hell get 40k did he put all the deposit down? Like post above said surely they'd get 25k each
