State pension overpayment at death

My aunt died on Sunday 18th December 2011. Her pension was paid weekly on a Monday. I notified the DWP of her death by phone on Monday 19th December 2011. I had expected to have to repay 1 weeks pension (approximately £140) however I have received a letter telling me that £427 is repayable. Can this be correct?

    Do you know how much the DWP actually paid after December 19th?

    Did she also receive payments on Thursday 22nd and Thursday 29th? You will need to check her bank account.

    Suggest you give them a call. They are very helpful and can give you details of their claim, which you can then check against your Aunt's bank statements.

    I don't know, but I wonder if, in the circumstances, a proportion of the winter fuel allowance would be reclaimed ?

    No, there's no clawback of Winter Fuel Allowance. It is paid in full and is even paid into a deceased person's estate if they were alive on the qualifying date in September.

    As said earlier, the bank holiday payments were received early around the 22nd and 29th December, so this may account for some of the overpaid amount.

    It can happen that the state pension continues a few weeks after the death notification, but I would have thought that a reliable notification was by the signed BD8 white form obtained from the registrar, rather than by phone ? Why would DWP stop SP based on a phone call ?

    because that is the new way of doing things now, they have bee doing it for while. Our centre takes calls for those under SPA and routes the informaton around the JC
