firstly may i apologise for bein naive i was made bankrupt sept 2010 and was discharged last febuary. now all of a sudden i am being contacted by debt collection agencies asking for money which of course were included in my bankruptcy i havent cleaned up my file as of yet is this why they are contacting me??? i had a very unpleaseant chap on the phone tonite from allied international insisting i give my address which i refused. I have not and will not ever have credit again so all my debt was included in my bankruptcy, i thought all this was over and now i find myself awake at night i am paying and rightly so a substaintial IPR this will be the 4th person to contact me can some one please advice. my thanks in anticipation :eek::eek::eek::eek:

Hi CHEZ1, I would clean up your credit files as this will help to stop your debt being sold on and send Fermis letter to the annoying chap, send recorded delivery and TYPE your signature don't sign.......companies in the past have been known to do a few naughty things with signatures.

NB: Equifax was the only one that I couldn`t order online, print off the application form and post this recorded delivery.

NB: Others have had trouble here too, they would rather you pay £12 don’t do that just print off the application form and post this recorded delivery too.
They are £2 each for paper copies. Some people have used the online one's and have said the information was very poor compared to the paper copies.

I would point out that the account was included in my bankruptcy which commenced on <date>.
Consequently, the debt in question is no longer my legal responsibility.
ALL contacts and claims regarding the debt MUST be addressed to the Official Receiver's Office dealing with the case.

Please also note that we are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when the debt is not due.
In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
In addition, your continued telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.
This type of debt collection method is contrary to the Consumer Protection from Unfair Trading Regulations 2008, in that it is intended to cause alarm and distress to the recipient.

A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.
