Statute barred help please?!
Comments
-
THe statute applies after 6 years on no contact/payment or acknowledgement of the debt by yourself.
Regardless of wether the debt collection company purchased that debt within that time frame - if it is after the 6 years and you (not them) have made no contact with anyone concerning the debt, it becomes statute barred, the debt is not legally enforcable, ie they can not take you to court.
It is then up to the debt collection agency to proove that the debt is not statute barred, otherwise they can do nothing else.I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0
