The second a company "sells" on a debt it is settled. FACT.
The only thing Kathy you had to do to stop calls/letters, was to write to them to say:
"The Bill of exchange act forbids debts to be passed on and to that, "the debt" that you speak of doesnt exist. No further communication will be entered into regarding this matter. Any further calls will be recorded and passed to the police as evidence of harrassment. Any further letters requiring a response will be charged for and invoiced to you at £xxx per letter(insert any price you like,its legal) and you will be given 14 days to pay the invoice. I will take all necessary measures to recover any monies due to me that I have invoiced you for."
If they are stupid enough to write to you (they wont) knock up a covering letter explaining that they were warned and that you have enclosed an invoice for your response. Tell them any further correspondence will mean you believe you have suffered "a tort" and that you will be claiming "a lien" of £100,000 off them. Knock up an invoice, send it and that will be the last you will hear from them.

Looks like a quote from someone (not you OP) who doesn't quite understand what a Bill of Exchange actually is, and seem to think that the Act prevents them being pursued for a debt that has been sold on. Fact is it doesn't, since a legal debt isn't defined as a Bill of Exchange. In fact this Act doesn't forbid 'debt' being passed on since it specifically allows for the transfer of 'bills' between parties. Throwing words like 'tort' and 'lien' around doesn't make it more convincing.
The closest anyone is likely to come to anything covered by this Act is when they write a cheque.0 -
There are many internet forums inhabited by all sorts of nutters and crackpots who will happily spout their dubious and misleading theories about how to get out of debt.
Don't fall for it unless get particular enjoyment from being laughed out of court.....0 -
