Vehicle Loan

I was declared bankrupt in November 2009, and have now been discharged since 2010 , I have a vehicle loan that I don't think was on my SOA as it was my vehicle I used for work, that was taken soon after the bankruptcy. I went to court and informed the judge that I was bankrupt, and that was the end of the matter.

Now it has a default date of April 2010 when I went to court, but they have not in fact had any payments since May 2007 on my credit file it says up until October 2008 at least 6 months in arrears, and from then its marked 'US' until March 2010.

Got a couple of questions, shouldn't the default be from when I didn't make any payments from 2007 not 2010 ? And am I allowed to ask the creditor to mark this satisfied, partly satisfied or closed ? its open at the moment.

Many thanks

you seem to be saying the loan was taken out AFTER you went BR if this is the case then it will not be included in your BR.

No that loan was taken out in 2004, I paid for more than 3 years on it, then had financial problems from about 2007

in that case it depends what form of finance it was bought with,if a straight loan then it should be covered but other forms of finance work differently if it was HP,Hire purchase then I believe that may work differently as the car may not pass to your ownership untill the last payment is made,so sorry it's not a straight answer,if you post which form of credit it was then I'm sure someone more up on the ins and out of credit will be more able to help.

It was a hire purchase from Lloyds TSB Asset Finance, it was for a commercial vehicle and for business use.

just to be clear have you still got the car? edit sorry reread your first post and you say it was taken, thought you meant the loan was taken then lol thats were the confusion came in.

the 2010 date may be wrong (someone may know this for sure)but like I say HP can work differently, even if it is wrong it is very near to your BR date that it will drop of around the same time anyway but yes you need to write to them and get it marked as settled or words to that effect.
the sticky at the top of the page gives you letter templates that are good to use.
