  • A couple of CCJs that will be unenforceable is the worst case; but personally I don't think it will happen. I walked away from debts nearly 10 times yours, Fuffa, after all I got when I tried to negotiate was to be treated like a piece of cr*p. So I thought, stuff you, you will get nothing.

    Number of letters received, 600 + from every debt collection agency under the sun. Number of letters replied to, zero. Number of court cases, zero. Time to all debts going statute barred, 18 months and counting. I have learned the system thoroughly and believe me, every last one of them is a parasite that you should not give your precious money to, concentrate on looking after your family.

    It's worked for me and it will work for you. You sound like you are making a fresh start in life, don't handicap yourself by feeling you have to enrich the leeches.

    The credit file system is simple. You either pay it all, or you pay nothing- there is no point in partial payment or late payment as you will not rebuild it like that. They give you no credit for that, so don't bother.

    I really don't think anyone will waste money applying for a CCJ- it will cost them over £100 up front for each, and they won't risk that if they have had no communication with you. Even if they did, you can get it annulled if you show you were never served with the paperwork and you weren't resident in England when it was issued.

    in her situation I would do EXACTLY the same - hopefully I will never be in her situation as you never really know what you will do until you are in it do you - I say that to those that will no doubt criticise me and you for giving her the *best advice in her current situation, taking all avenues into account* which is truly what this forum should be about!

    We are not here to be moral Police. Some should remember that and if they have no helpful comments to say, should go take their moralistic ranting elsewhere :D

    Surburbanwifey, I've been coming on here for about 18 months and can honestly say that I do not recognise what you describe at all. The DFW forum is a place of support and advice that can help people make their own decisions without being belittled, railroaded, or ignored.

    I am amazed, and sorry, that your experiences are of moralistic ranting, moral police and that the forum is 'filled with moralistic, perfect people.' I am equally surprised that you would want to be part of something you feel is like this.

    Anyhow, this simply is not the forum that I see at all and not one that I would want to be part of and I do think it's a shame where sweeping generalisations about a forum's membership is made, that could make desperate people think twice about posting.

  • Well, my comment too, SAAC, I suppose I got a slanted view when two of them appeared on a thread I was on apparently championing the rights of the banking industry... the tired old "you borrowed the money so you must pay it back" moralists. Never mind that the banking industry was a MASSIVE defaulter itself... that was all the fault of these poor people who didn't sweat blood to repay them? I don't think so. Maybe you are right and they are in a minority? They simply annoyed me because the advice here should be to benefit those who come to us, and if the advice is, as here, turn your back on it, I don't want to be attacked by some self righteous prig for giving it. Rant over!!

    Well, the lassie who posted was asking for advice on how to solve her particular problem. I am not aware that she asked for questions as to what happened as to any debt she was unfortunately unable to repay.

  • If you really want an answer to your question Happytogetdebtfree, all financial organisations have provisions for a certain amount of bad debt, debt that will not be repaid and that they cannot collect on. Bad debt is a risk factor for anyone who lends out money ... see Zoper UK loans where individuals factor in the loss risk when lending sums of money in the hope of great returns. Most pay, some don't, bad debt is a fact of life. Those bad debt risk factors are taken into account when setting charges and interest rate levels, even if no one defaulted, they would still factor in that risk and the small cost would be spread throughout all payers, as has always been the case.
