123av.co.uk sold me a clearly used TV - options?

I ordered a TV from www.123av.co.uk, based on the fact that it was about £30 cheaper than other places were selling it and their customer reviews were quite positive.

It arrived today and it's clearly not new in the slightest. For one, it came in a completely different Box (the box was for a much more advanced LED TV), the TV didn't fit properly inside it (see pictures below), the plastic film had been reapplied and aside from the LG manual CD, there were no official documents inside - does this thing even have a warranty?!

I also happen to know that LG TV's have a "first-run" startup mode to set the picture and such, but this didn't happen. Luckily, the TV itself actually works ok (I think, haven't really had a chance to play with it much) but I'm very worried about this.

There was nothing on the site to even remotely suggest that it was new, refurbished, ex-display or anything like that. As far as I was aware, it was supposed to be a brand new TV. Annoyingly, it's no longer listed on the site so I can't get the description directly but the order doesn't suggest any of the above, either -

Is this even legal? What are my options here, aside from just returning the thing?

  • I would personally send it straight back for the reasons you've listed.

    Even if it works now, considering the company have sent you a used TV means you may have problems should it eventually go wrong.
    I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!

    I was browsing through their site and a few items interested me and upon reading the description, in a very cleverly placed area (where it lists the specifications of the item) on the last line it says "Manufacturers Grade A Condition." which according to them means that it was a return item/unwanted item/tatty packaging etc.

    However, their returns policy seems very reasonable. Just don't mention it’s because it wasn't new as they'll tell you that you failed to read the description. Granted, it is cleverly placed, there just is no need to go down that route.
