re: unfair dismissal

I currently work for the NHS and was told that our department would be closing in two months due to high costs within the hospital. However, one post is still to be left open with a new job title. The job is exactly the same as I currently undertake. I receied letter from official managementand HR that stated my job is at risk and the department will close in two months; however, my two managers recieved a letter that stated they can apply for the job and one of them would be selected for the role. I find it quite unfair that I and my fellow workers have recieved a different letter about job termination compared to my managers; also they can apply for the job and have been pre-selected even though I have been doing the same job for 6 years. Could anyone advice me if I can claim for unfair dismissal or not being treated equally. Do I have a just claim? If any can advice it would be much appreciated. :mad:

Hi, I can't offer any advice except to contact ACAS &/or the CAB first thing! I think it's disgusting that not only are the NHS closing more departments but are trying to stop you having a chance at a job you already do! As far as I know, I think they have to advertise the job to everyone, not just the managers. Hope it works out, i'm sure someone who knows about these things will be along soon. Contact your union.
Email the HR team v/ Director & ask them to put in writing their reasons for not suggesting you apply for it.
ASk for a copy of the jd for the new job. If there is a 70% similarity you should be considered for it under slotting in processes and should be applying for it.

Since you have been identified as having a post thats "at risk" it would suggest that the consultation process has begun.You need to raise your concerns with your trade union and ensure the trust policy on redundancy selection is being complied with.Your branch office will have dealt with this in the past and they are the ones to obtain support from.Don’t be a can’t, be a can.0
