Fredrickson International!

I have debt against my name which isn't mine. I requested a signed credit agreement from them in July '11. This stopped all attempts from them. Last month in Jan '12 I receive letters from a company called Fredrickson International demanding the money and saying they have bought the debt off another company (A company I have never heard of).

To me the 1st company have sold the debt on, and then the next company has sold it onto Fredrickson without even attempting payment?

Now I have received a letter demanding the money or I will go to court and bailiffs will be called out.

Is this their attempt to get me to speak? As I have not spoke to any debt collectors since I asked for the Credit Agreement in July.

Also how can a company sell a debt on when I asked them for a signed credit agreement?

Please help this is worrying me as I am getting tired of them.

I first made a top back in May '11 I think if people would like to know the full story please ask or just search for threads I made.

    Yeah.

    Please can someone tell me if this is normal? Selling on the debt I mean.

    I have an appointment with CAB at the end of the month but they are demanding money within 7 days. I am fairly sure it is just to get me to talk but I would like my mind but to ease. :(

    It is normal I'm afraid. One debt collector realises the account is useless to collect, so they flog it on to a new one who may not realise when they buy it. Then you get the same merry-go-round all again.

    If it was me I think I would write and say that.

    - The account in question is one that was taken out fraudulently.
    - Explain those circumstances.
    - The previous collectors refused to provide any evidence of who signed or took out the agreement.
    - That the account is currently unenforceable.
    - That the account is currently disputed.
    - That if Fredricksons wish to collect then they must provide absolute proof of who took out the account in the form of a genuinely signed copy of the agreement.
    - That if Fredricksons fail or refuse to do so then you will report them to the OFT and trading standards.
    - That if Fredricksons pass the account on to another collector to avoid this dispute, then you will likewise report them to the OFT and trading standards.

    why not contact the catalogues fraud department, also ask where the goods were delivered to
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Chanz4 - I know who it was. Mentioned in my last thread. The story is long so I didn't want to type it up again. I just needed these questions answered. Thanks for the reply.

    This is getting me rather depressed now.

    They have come back and told me if I think it is fraud then to go to the police and file a fraud complaint. I asked them for the signed credit agreement which they provided but without my signature. They state this is what is sent out to all customers.

    This is no proof that it is my debt.

    I don't really want to go to the police with this as if no-one is aware, this debt was taken out by my mother who passed away in Sep 2010. I only came aware of this when clearing her house. So I feel a bit silly doing that plus why are they telling me what to do when they can't provide me with what I asked for?

    Help :(

    I can guarantee they will not find anything with my signature on it. My main concern is that they will not go away and ruin my credit :(

    Whether you report it via action fraud or the police it your call really.

    Regardless, no a blank agreement is no proof at all. Their excuse that this is what they normally provide is a load of bullwarks.

    If you can be bothered you can repeat the same points again, but add that.

    - You are now reporting their refusal to supply proof that you are liable to the OFT and TS.
    - That this is now a formal complaint and that you require a copy of their complaints procedure and a final response that you can take to the FOS. Will cost them £500 it you take it to the FOS.

    I know each case is different but what are the chances of them taking me to court over it?

    They will know they can't go far without a signed credit agreement so will they bother?

    I am now to the point where I come home from work and a letter on the doorstep or no letter depends what mood I am in the rest of the night :(

    How do I complain to the OFT? I do not want this to go on for the rest of my life! I can ask them to send me things but it won't clear the debt from my name :(

    Court is unlikely, as they surely know that they are on very dodgy ground.

    If this was taken out after April 2007 then technically a signed agreement may not essential for court action. But they would have convince the court on the balance of probability that the debt was yours. Considering where it was taken out, any payments came from, etc then they would probably struggle to do that. Which I'm sure they know.

    Please don't let these people get you down.

    Being a pain in the backside and bloooody awkward is part of their strategy to bully you into paying a debt that isn't yours.

    They hope to grind people down, whether they owe it or not, and obtain payment that way. Probably about the last thing they want to do is go to court.

    I have just re-read what they sent me. It has printed in the corner of the document 'PLEASE DETACH THIS COPY AS INDICATED AND RETURN IT TO US SIGNED AND COMPLETED' well if it was signed and completed where is it?

    Also this account was taken out in March 2006.
