Hi,
I wonder if any of you can help.....
Ive recently recieved a letter from past employers stating that i was overpaid in my last paycheque by the sum of 800 quid, and must settle my debt as soon as possible. Does anyone know where i stand legally on this matter (i.e. whether i have to pay em back or not?!) im a student now and haven't a hope of sending them a cheque for £800 as they've asked! Has anybody else had a situation like this or know where i might stand?!

you will have to pay them back as the money was never rightly yours. You have no right to keep it and they will take you to court if you refuse to pay it back. However as mentioned by nomoneytoday you may be able to talk to them and pay it back in installments. It was their fault and even though they expect the money back if you explain the situation the may be willing to work with you.

Just to take a step back, do you agree that you were overpaid? If you genuinely do not believe that you were overpaid, you should contact your former employer and ask for them to look into it further. If you do agree, then do as nomoney and ovetta suggest.0

Out of curiosity did you not think when you got your pay check with an extra £800 in it that they might have made a mistake and might want the money back at some point?

By law you have to pay them back if your contract says so and most do.
You should make your offer in writing and explain that you are a full time student and name the institution. Send the first instalment with your offer and use recorded delivery or hand deliver the letter. Keep a copy.
Keep up with the instalments and keep a written record of all repayments so use a cheque rather than cash, and they are unlikely to take you to court.
They may harass you with a solicitor to try and get the money back in one lump sum. Just acknowledge the letters and refer them to your first letter. Don't give them any financial information as they are not legally entitled to know you income and outgoings. They have to go to court to seek this information.
If they continue to harass you then warn them in writing that you will take action against them for harassment. (You can and you can win which means you don't have to pay them back at all.)
If they do take you to court you will be obliged to give the court financial information but if your payments are reasonable and you keep up with them then you are extremely unlikely to have a CCJ awarded against you.I'm not cynical I'm realistic

In response to Clive, I had done a lot of overtime that month, and so just blindly accepted that what they'd given me was correct! In hindsight, as a newly skint student, I was probably just floating along in denial. I will have to be more vigilant in the future!
I've wrote to them asking to make sure what they're asking me for is correct, as RibenaBerry suggests. Do you think they'll take 50p a week?!

There is a scam going on at the moment which unfortunately my husband got stung by yesterday.
He is not stupid by any means and is a company director but so good is this con artist that he got caught.
Coming out of car park in Coventry, an italian man approached him with a story about how he was on his way back to Italy after attending a fashion conference at the NEC ( this conference did happen and La moda did exhibit there ) .
He said he was a rep for la moda and he just had these 4 jackets left over at the end of the show. He was on his way to the airport and did not want to pay excess luggage to take them home but would my husband consider having them for the price of his hire car ( £260 ).
the jackets looked good ( or the 2 he looked closely at ) and the guy was very plausible with a seemingly soft sell. He also showed him his passport and pictures of wife and family.
He parted with the money and then rang me. As soon as i put reportage jackets into google it came up with scambusters website with similar stories from around the world. The jackets are PVC not leather and certainly not Armani. Please beware. If this post stops one of you falling for same then i have not wasted my time.Everything you need is out there - you just need to ask..................:A0 -
