Loan company can provide details of where they sent original loan to - help?!
Right briefly the scenario is as follows:
Loans taken out for 45k. Joint names Mrs kind of conned Mr into signing without him actually realising how much it was for. Mrs unemployed and Mr sole income and paying loan back. Loan taken out to clear Mrs debt from previous marriage.
Mr and Mrs now split and then he realises this debt exists and wants to know what it paid etc etc. Contacts loan company who advise they have no details on file regarding where the money went. Also strangely have Mr DOB incorrect on file.
Question is...how to proceed in finding out where this money went - how can you pay for something that you dont actually know you had in the first place.
Any help appreciated - let me know if you need any clarification.

You say it's in joint names. Which means he signed an agreement. What does that say?0

When you trust someone and you are in a "happy" marriage and they tell you something you trust what they say...it is easy to catch someone in a rush and ask them just to quickly sign something! People are conned everyday - its not that hard to believe!! You don't have to be out of your mind to be conned and I find that comment quite offensive!
The problem isnt really whose name it is in. Its more about the company who provided the loan being unable to provide information about the loan itself. If they cant prove where and when they sent the funds...why should he pay it back?0 -

because you signed the agreement and the money went into either your or your exs account. now if she faked your signiture that would have been diffrent. but its not the loan companies fault that you were conned by your wife.0

The orginial aim was to prove the the consolidation of loans was in Mrs name alone. The loan company cannot provide this information which will then have serious repercussions.

Your posts are so contradictory. Your OP states 'joint names' then you say it's not about whose name it's in, then your last post says you want to prove it's in the Mrs's name. I think you need to re-post your thread with absolute facts.0

right so...original debts were in Mrs name. A consolidation loan for 45k was taken out in JOINT NAMES.
Then divorced.
Then Mr realises debts when visiting property - two bagfuls of unopened letters! One of which was the 45k loan!
To prove that Mr is not responsible for the 45k loan he would like the original details of where this money went. The loan company who provided the 45k cannot locate the file or provide any evidence of where the money went. Therefore whose name it is in etc is not relevant. the relevant bit is what to do about this compant that cannot provide this simple information!0 -
But my point is that you may have made an agreement but if you dont know that you have ever received that money (the original 45k) then why should you pay it. (in reality he isnt going to stop paying it but you get my point) Data Protection Act/ FSA etc etc state that records should be kept. If these records are not kept then what are the implications.
Surely they legally have to prove where they sent this money.
Mr seriously has no idea where this money went - if it was received etc etc.0 -
Not much clearer really, either Mr (is it you?) signed and started paying for this or not.
You say Mrs had no means to pay.
You say loans as opposed to loan - so there is more than one joint loan?
You say it was to pay Mrs's debts.
I can't make head nor tail of this.0
