old debts

Hiya,
I have just received a letter from Bristow & suiter regarding debts that were run up in 2004, 2005 and 2009.
My question is whether the debts can be collected when it has been so long since the debts were run up?
believed these things were dealt with properly by my ex-husband, but it appears he did not pay them.
There is no contact with him now and i don't want to rock the boat by sending the debt collectors after him.

    Has there been any contact between you and/or your ex husband and the creditors?

    Have any payments been made?

    Are the debts joint?

    Debts which have not been acknowledged (by payment or written communication) for 6 years cannot be pursued at court (statute barred). It is possible that the 2004 and 2005 debts are statute barred, but that depends on the payment history. The 2009 debt is not an 'old debt' and will need to be addressed.

    very important is this your debt or your former partners. if its theres not something to worry about.

    Hiya,

    Thanks for responding.

    The debt is in my name, my ex dealt with bills etc at the time, that was until i discovered he was not. I have addressed other bills but did not know about this one, i will sort this without his help but want to know where i stand with older two debts.

    I have looked at the letters and the original debt owing for 2004 was £891.00 ammount left to pay is £626.52. The 2005 debt was £926.87 but now has a balance of £828.37. This means my ex was obviously aware and had made some payments, i don't know when he stopped making these payments.

    SB works on the last time a debt was acknowledged or a payment made, so we really need to know when the last payment was made. Personally, I'd stop what you are doing and send them a Prove It letter stating that you wish to know to whom the debts are attributed, the creditor, the amount, a statement of account and the date of a last payment. This sounds allot like a fishing expedition by a known shyster company who specialise in squeezing money out of people for debts that are long since either settled or SB. If they are, as we suspect SB, just send them a pi$$ off letter and be done with it, but we really need to establish the provinance of the debts before going down that route. I can help with letters if you wish, I just wrote one for another thread tonight which you could use if you are sure of your position.
