No refunds, only replacements???!!!

Bf bought a Nintendo DS from Game, it had 2 dead pixels. He took it back and asked for a refund and was given the answer "We have a policy not to refund on hardware only replace it"
I think this is illegal isnt it? Have had a look on consumer direct website and it says if it's faulty then he's entitled to a refund. The replacement one he has been given also has a dead pixel.
Any advice please?
