Naturally I waited 51 weeks. The prats had not raised an assessment. Now they have, though, so time to get down to work and see it off!

    Hi all,

    An update.

Finally HMRC have responded to my letter. Apparently I still "owe" £4735.70 (different to the figure quoted over the phone to me).

    They state the following:

    2008-9 - P11d received in circa June 2009

    2009-10 - P11d received circa June 2010

    2010-11 - re-estimated benefit on 30 December 2010

This indicates they didn't process the P11ds for 08-09 & 09-10 until December 2010 (I asked for the exact dates however they have not provided them).

Any ideas on what to do next?

    Thanks

I suggest you set aside an hour, gather up all your paperwork for all the years in question and look up on the HMRC site the allowances and tax bands for each year. Then get paper and pencil, fire up your calculator, and work out your total income, the tax actually due, and the tax actually paid for each year individually.

This earlier comment from jennifernil is really the best advice. It was the only way I managed to understand my own tax.

Make one list of all your benefits from the P11d's and another of all the tax adjustments that have been made from your tax code notices and see what has been missed.

I found out that it had taken them 2 years to tax me for private medical and then they had continued to tax me at the benefit amount of the first year even though there had been annual increases. I now update HMRC myself by phone with any changes and seem to receive code changes within about 1-2 months.

I'm not a tax expert, just a regular e/ee, but the list method made it clear for me. Best of luck.

dont know if anyone can help me but I have had my tax code changed so they are taking more money from me. I spoke to HMRC who informed me this was due to having been over paid Working Tax Credits. however I have spoken to Working tax credits and they say I dont owe them anything at all. after 4 hours on the phone back and forth between the two I ended up having to ring the WTC back to ask them to send a letter confirming this as HMRC wouldn just take my word for it, however the WTC now say they have no details for me what so ever and I have got to go down to the local tax office to prove who I am. I have also been told they dont send letters out. I am totally stuck as to 1. how to get my tax code corrected as no one seems willing to help. 2. How the Working tax credits have managed to lose my details in the space of an hour?

I have never dealt with such incompetant offices as HMRC and the Woking tax credits seem to be.

I've just spent the last 6 months trying to get HMRC to admit responsibility for incorrectly taking £500+ in additional income tax that was not owed. Finally, Gerry Newman the Deputy Director of Personal Tax Operations has admitted negligence but still refuses to refund the overpaid tax ( + expenses + interest + compensation). The government runs scared of the HMRC and allows this despicable organisation to treat taxpayers with utter contempt. My next stop is the Adjudicator's Office.
  • they are a total nightmare. I have got to go down with ID at some point when they contact me with an appointment so I am not leaving the office untill I have some sort of answer. I am certainly going to fight this to the end though

"HMRC produces periodic updates and Aries has been examining this latest list of changes, which appeared on 29 March 2012.

Page RPSM03105610has been amended with the description: “correction of monetary figures in the example”. However, the amended results they produced included the following:

    37,500 + 60,500 = 92,500; 25% x 120,000 = 27,500; 30,000 + 27,500 = 60,500

Aries director Gary Chamberlin said: “It’s a bit of a shambles, isn’t it?

"This is the government department responsible for collecting the nation’s taxes, and it would seem it hasn’t yet got its GCSE in arithmetic. It does rather dent my confidence in HMRC.” Aries devotes resources each time an RPSM update appears, examining the results and writing a report listing what it believes to be the errors and omissions, which is often a lengthy list.

"The team at Aries recognises the importance of reliable official guidance and therefore completes this service to the industry in an attempt to achieve clarity on the major legislatory items."

Maybe the Beecroft recommendations should start with useless organisations like this one.

The appointment is to set up security questions as you failed security when you rang them the second time. The appointment will also only be for 15 minutes as that is the length of time set aside for a Tax Credit security appointment.

The reason the overpaid tax credits is not showing on your tax credit claim now is because it has been transferred out to be collected via your PAYE tax code. An initial look by the tax credit advisor will show each year as balanced. It will however be in it somewhere as an adjustment against whatever year/years they arose.

I think your entitlement to Tax credits has probably ceased and the claim ended so they have no award to hold back from you to claw back the overpayment so they have transferred it to be deducted from your pay.
