Employer not paying wages.

I wonder if anyone can help, I am asking on behalf of my granddaughter. She has been working for this large company and has a disability. She has been off waiting for adjustments to be made that her employer is reluctant to do.

She sent them fit notes to this effect, for the past 2 months her salary has deductions and last month she did not get paid at all.

Can she claim constructive dismissal.:o

    HaS the employer told her to take the time off until the adjustments have been done?

  • Did she ask about the deductions? Is it because she is off sick so they are only paying SSP? Fair enough. As long as they are paying SSP amount as a minimum (assuming she qualifies for it) that's fine.

    Has she asked them why they haven't paid her at all this month?

    Has the employer agreed to make the adjustments? Have they instructed her to stay off work until they are made? Or has she gone sick because she cannot work without the adjustments?

    Is her disability such that she cannot work without the adjustments?

    She worked there for 3 years, the adjustments have not been put in places manager thinks she can work without adjustments being in place.

    No pay for Jan because manager said that she should have kept in touch with them more when she was signed off due to no adjustments being made, she did keep in touch by writing, but that was not enough.

    Can she see her PI at work or is that not allowed.
  • GD says that her employer know she is fit for work with adjustments, she had access to work in last year and they made recommendations but manager said they will be purchasing be purchasing the equipment but it has not been approved yet by their head office.

    They will not send ther to OHA as there is no inhouse OHA and it will cost them moeny if they recommend her. Manager said that she knows GD is fit for work and she need not go to their OH.
