Sick Pay Advice

Hi there

I will attempt to keep this simple.
I broke my ankle in a work related accident on October 30th 2011. After it became apparent that this was a bad injury and my time off work would be extensive, I informed my company and was "informally" advised that I would receive full pay for the duration of my recovery. I was off for 12 weeks. No futher communication was received from my comapny, however I supplied them with weekly phone and e-mail updates and all of the correct certificates. On returning to work 12 weeks later, my payslip indicated that for teh previous month I was only paid 50 per cent of my full salary. There was no communication from the company informing me of this.

I would have preffered to have been given prior notice.

Is this fair, should they have informed me that they were going to do this?

My contract terms of employmant are ambigous and open to interpretation when it comes to sick pay.

  • You were off 12 weeks and it is only when you got into the office that you noticed that you were only getting 50% pay? Didnt you see the money going into your bank being low?

    Are you claiming personal injury for your break? If you are your loss of earnings can form one of the heads of claim.

    Maybe I did not make my self clear. I was in formed that I would recieve full pay. I did for two months then when I returned I was only paid 50 per cent of my salary. What miffed me is that I was not informed.

    I thought that employment law stated that for an accident at work, that after six weeks that pay rate had to be negotiated in my case I was verbally informed that I would receive full pay, so with this in mind I did not make a claim for injury. However the company changed the information they gave me, stating that I would receive full pay without informing me.
