NHS Special class status career break clause?

Can anyone help? I joined the nhs scheme in 1983 but had 6 yrs out (91-97) as a Practice Nurse. At that time we were excluded from the scheme so not my choice. We were allowed back in 1997 and I've been a member ever since. I was given the option to buy back some years but after consideration decided against - BIG MISTAKE given what's happening now! My question is - has that 5 yr break clause always been in place or added more recently? I am absolutely positive had I known about it - I would have protected my rights at the time. Now all I can do is feel sick that I've let a prime opportunity slip away 😥. If anyone can help I would very much appreciate it

From the NHS pension FAQs:

Q. I was a member of the special classes but have had a break in membership of at least 5 years and rejoined again after 6 March 1995, can I be granted special class status for my further membership?

A. No. If you have had a break in membership of any one period of 5 years or more and rejoin the NHS Pension Scheme on or after 6 March 1995, special class status cannot be granted.

My understanding is that there is nothing you could have done to protect your rights, other than to go back to NHS work prior to 6 March 1995. Your option on special class membership has gone, I'm sorry to say. The NHS pension scheme is still a good scheme, even without the special classes benefits.
