Claim form re 1st Credit

After a long period of silence I received a claim form purporting to be from Northampton county court lodged by solicitors Judge & Priestly representing 1st Credit. My first question is, is this legitimate, or just a ploy to get my written admission? I have yet to receive a legible copy of the original CCA and my last communication with 1st Credit was on 20th September 2010 when I again requested a legible copy after they sent me a letter quoting "Please act now to avoid an agent attending your property". The debt was initially with Goldfish, with whom I made an arrangement to make regular monthly payments, and they agreed to freeze the interest. This debt was then apparently assigned to 1st Credit who demanded payment in full. This claim form is now also claiming for interest since September 2008, at 8%pa, and now 2.17% PER DAY from 1/2/2012 until judgement or sooner payment. The original notice of assignment came from 1st Credit's address, and was undated. Accoring to the form I have 14 days to respond from today. And would be very grateful for any advice you good people could offer me. Your advice at the start of all this in 2008 was highly useful, and stopped 1st Credit harrassing me by phone.
Please help!

You can telephone the court and ask if they have issued papers to you.

Do you intend to defend the claim? Or admit it and make a proposal for repayment?

I'm not sure. I admit the original debt to Goldfish, but now I'm faced with a huge extra amount in interest. I will phone the court though, to check this form is legit. Thanks

  • Just wanted to add - If you do admit the debt or defend & lose - there should be no interest added from when the ccj is issued since the debt is covered by a CCA.
