Final Wage WRONG!!! Help

Hi i am hoping someone here could advise me on the best cause of action to take.

I finished employment on the 16th of january. I came to an arrangement with my employer that they would pay me until the end of the month (31st Jan) As i was owed just short of 2 weeks lieu and 3 days holiday.

I Later received my payslip, and had only been paid until the 16th!

I Have contacted my line manager 5 times who says she will look into this, but never getting back to me. I then contacted my area manager who disconected the call.

After speaking to a collegue i was given the number for payroll directly, they stated that the overtime was never authorised and i need to speak to my line manager!

As you can see i am just going around in circles!

    If you are owed it, it's not an arrangement at all it is what you are owed.

    Write a formal letter and send it registered post to them stating what you think they still owe you and what it was for.

    Should you need to make a claim for the money (via an employment tribunal) you MUST lodge the claim within three months of when the money should have been paid. Don't be strung along and run out of time.

    Do as suggested above by LadyA, if no response send a further "letter before action" saying if it is not paid before a certain date (short but reasonable time frame) you will commence legal action without further notice.

    You can file an ET claim online and there is no fee to do so. You can withdraw it if they pay up.

    Hello although I cannot help, I can sympathise as I'm having exactly the same problems with my ex boss. We have agreed the amount I am owed, and he is being really awkward about payment the last £500 due. He has sent a chq but in the wrong name (clearly on purpose)

    After 2 months of going round in circles, I am now looking to take it further. I was hoping to avoid doing this and hoped my boss would just pay up, but it doesn't look like its going to happen.

    Do be careful though, as if you threaten action you are unlikely to get a reference from the employer in the future. This happened to me and although I managed to get references from elsewhere for my current temporary job, I still may be in trouble with future applications and references.

    And if the 'threat' of it works and boss pays up, would there be any charges for withdrawing it? Hope you can help, thanks
  • Thankyou for the support and advise so far. I Have posted via recorded delivery a letter requesting the amount owed. I Will give them until this friday to respond.

    You will then be able to see who has signed for it and when so they can't deny having it. What the do with it is up to them but then follow it up like said above if you get no joy with a final letter giving them say 14 days to pay which is reasonable.

    As far as a reference goes I do feel if everyone went round being scared of a former employer it just leaves it ok for them to abuse staff and short pay them & we shouldn't let them do it!
