Mortgages fees reclaimed - Martin help!!

Hopefully someone may know. I have paid some whopping fees on two mortgaes Halifax and aBBEY when I left them to remortgage. I was originally with my partner who I have since split up with. I have gone on to make a claim to the building societies and have had to give names of the joint policy holders which meant that only I could sign the application for claiming back the fees and had to leave a blank space for the signature of the ex. Obviously cant and dont want to try and contact her. The question is, can the building societies legally use this as an excuse not to pay up or process the application. It was after all my mortgage too so I should still have a legal right to make a claim. I am expecting them to say 'sorry we need both signatures from both holders before we can process it'.

If you are talking about paying "whopping" redemption fees, you must mean Early Repayment Charges (ERCs) and not Mortgage Exit Adminstration Fees (MEAFs).
If so, there is no legal basis for reclaiming them - the recent FSA ruling relates solely to MEAFs.
Whichever fee you are talking about, if the fees were paid on a joint mortgage it's quite reasonable that the lender requires you both to sign to request any repayment, and also that any repayment will be made jointly to all account holders. If you have since split up, it's not fair for you to run off with your ex-partner's share!0 -
It would be worth making clear that you want the refund paid as 2 separate cheques; otherwise the bank is likely to write one cheque addressed to the both of you and I'm assuming you no longer have any joint bank accounts...I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
