ccj help with water company

im new to this site and hope im not spoiling a thread, but ive recieved a ccj re:yorkshire company for non payment of water bill, basically whats the worst that could happen if i ignore this??
im not trying to be clever,its a case of i dont have the money to pay it. the letter states i have till 9th feb 2012 to pay or they send a bailiff, ive nothing of any value, so if i burry me head in the sand what will happen, many thanks.

    The bill will get higher and higher with bailiff charges.

    Worst case - they send a bailiff around, you let them in and they levy on your goods. Then a few days later the bailiff comes back and collect your stuff to sell at auction and settle your debt. (you don't have to let the bailiff's in, but they will charge you for knocking on your door!). If you have a car don't park it outside your house.

    Speak to CCCS or National Debtline, work out how much you can afford to pay (with a full SOA) and get in touch with them. Once you have a figure contact Yorkshire Water and make them an offer to pay in installments.

    You had the opportunity to do this before the court date, so ignoring the letters has made it worse, but you can hopefully get it sorted out and pay back a little at a time.

    Well if they send a bailiff providing you don't let them in to the property and providing you don't have a car/motorbike outstide then there will be little they can do.
    After that your creditor would probably consider other enforcement methods, eg perhaps an attachment of earnings if you aer employed (money taken out of your paypacket by your employer to repay the debt).
    All enforcement action will result in fees which will be added on to your debt.

    Did you reply to the court papers? did you admit the debt? ask to pay in installments?

    If you can't afford to repay in full then its best to arrange installments, either by talking to the creditor or by going back to court to get them agree to installments at a rate you can afford (you'll need to show the judge your income & outgoings and they'll assess what you can afford based on that).

    In terms of the worst thing that could happen - how much is the CCJ for? the worst thing might be that they petition for you to be made bankrupt (if the debt is over £750), perhaps not that likely but possibly the worst case scenario.

  • As far as I'm aware this is the only letter re:ccj. Yes I did ignore the letters from Yorkshire water,which wasn't the wisest move. The ccj is for £570.00. I'm on eesa. £67.50 week. So has you can tell what I'd be able to pay back is very little,would a visit to the cab do any good.

    As said, you may still be able to apply to the court to pay this by instalments if you don't ignore it. Or at least apply to stop bailiff action should that happen.

    Burying your head in the sand again will just cause you more grief in the long run, so make the phone call and talk it through.

    Go to the Yorkshire Water Company Trust website - they help those in your area who are having trouble paying their water bills. It may be too late but it's worth a try.
  • Can you not call and make an arrangement? Something is better than nothing and burying your head in the sand?

    I know how it feels, My ex was "suppose" to be paying our water bills and over the 6 years of living with him hadnt paid a penny hid the letters etc and when we split I got took to court for nearly 4k of debt with United Utilites I pay £140 a month so Im sure they will sort something for you x

    I do not want to worry you but sadly, many water companies are resorting to instructing a firm of High Court Enforcement companies (Sherforce etc) to enforce CCJ's that are over £600.

    It is VITAL that you do not put your head in the sand. You need to IMMEDIATELY file an N245 (Variation of a court order) to offer to pay by installments. If you are in receipt of the appropriate benefits, you will need to fill in the form EX160 to claim exemption from the fee for filing the N245.

    If the debt is passed the High Court Enforcement company the fees charged are typically around £1,500 and MORE. Please DO NOT ignore CCJ's from water companies!!!
  • update on my ccj problem: ive been intouch with yorkshire water today re:the money i owe them and ive had to give them my n/i number for them to take payment from my eesa £67.50 p/w they have said the lowest payment they can accept with me been on eesa is £12.20 p/w straight from my benefit,its to include what i owe and the next yrs bill,they say it will take 2 yrs to pay, it seams a lot £12.20 p/w, any one know if thats the correrct amount i should have to pay ?

    Any other income, either solely or within your household, do you get any benefits, housing benefits etc.

    Good for you for sorting it, unfortunately, you will have trashed your credit for a few years.

    Dont forget, the more you pay the quicker it gets paid off.
