2 CCJs I was not aware of

I have just looked at my credit file for the first time and there are two CCJs I was not aware of. I guess the papers must have been sent to my old address.

I am a bit worried about this because I was getting so close to having paid everything and now I find out about this. It would be just my luck to get a warrant of execution now.

So anyway, these CCJs appear to be 4 years old, and Im wondering what I can and should do...

Can I still make an offer to pay back over a few months or is it likely to be too late for that? If I can, how do I go about it?

Would it be better to save the money and then pay it off, hoping I don't hear anything in the mean time. And who do I pay, the court or the creditor?

Can say I didn't get the papers and get the CCJ removed? I'm sure it can't be that simple can it?

I'm worried so I would like to get it sorted rather than wait. Need advice.

    No reason why you can't make offers over a few months. Or you could wait and see what happens.

    It may be now that you've checked your file, the link on your credit report will have been made and you might be contacted shortly anyway.

    The creditor has to pay fees for enforcement, so unless they are utterly daft, they should be open to negotiation.

    If you pay it then you pay the creditor, but make sure you get proof of payment and confirmation that all is paid when it is. Helps to make it simpler getting the court to mark it settled.

    Why didn't you get the papers? Did you tell the creditors of your new address? If you did, can your prove that?

    Unless you can show you told the creditor your new address but they went ahead and issued papers to the old one anyway, then you will struggle for grounds for a set aside.

    If I decide to save the money and then pay them, but in the mean time the bailiffs send me a letter, I believe I can stop action by filling in some forms at the court making an offer of payment, is that right?

    If that is the case, does merely filing the papers stop action or does the court have to make some sort of decision first?

    Yeah. It's an N245 and you tick both boxes - suspend the warrant and reduce the instalment. The Court bailiff would hold off until this had been considered.

    You say you have only just checked your credit file. So do you know who the creditors are? If not, find out by phoning the court. Find out as much as you can before you decide how to play this.
