Been given notice but have been in there service for a year

    The P60 for the tax year that the OP commenced at the company should have a start of employment date on it. So the one for tax year 2010-2011 in this case - which should have been issued by the end of May last year.

    Sorry, my error. Start date is on a P11 rather than a P60. I'm more used to seeing the employers copy P11 which has this start date on.

    Well since they are saying you haven't been there a year you need to address the issue I think on when you started with the company and then I think (someone else will tell you here) that you have rights.

    They have so whether they can or not isn't relevant. But nor is it relevant to the dismissal. If you have a years service then you were entitled to a disciplinary hearing and failure to do this is unfair dismissal.

    Yes, providing you can show that you have in fact been employed for over a year (or 51 weeks plus a week in lieu of notice) then the fact that they didn't follow proper procedure makes this automatically unfair dismissal. That said, it doesn't in itself mean you would get much compensation which would depend on the circumstances.

    You need to get some one to one advice ideally from a solicitor but failing that the CAB.

    Concentrate first on proving the fact that you were employed part time before the so called start date.

    Have you checked your house insurance. A lot of people have cover for employment claims and don't realise it.

    You only have three months, less a day, from the date of dismissal to make a claim so don't hang around.
