    Thing is, if the OR want to make an IPA against me, and being honest any xs would be because of the maintenance, my ex will simply refuse to pay! Would they then get the CSA involved? This is the one thing worrying me with the whole BR, all the rest I can deal with.

    I'm hoping one of the board members who have more in depth knowledge will pop along and provide some more knowledgeable advice for you on this.

    However, your ex does not have to know what your arrangements are with the OR, it's none of their business surely? If your ex did reduce the amount or refuse to pay for any reason in the future, then I think it would be up to you to involve the CSA in the first instance. The OR doesn't get involved in what money you are entitled to, they just assess the money you do receive.

    I'm not "anyone else" but as I said why are you separating your benefits and maintenance? an IPA is based on income,if you were to say to the OR I have £350 extra money at the end of the month,then yes they will take some of it as you have told them it's "extra",the best thing you can do to put your mind at rest is fill in this form http://www.makesenseofcards.com/soacalc.html on your expenses,start another thread asking for pointers.

    Child maintenance

    Please do as INAN and sniggings have suggested a SOA and start a new thread entitled SOA and child maintenance.

    yep maintanance received is income, it does not necessarily matter if that income is what someone might consider earned or not, and is therefore subject to to the IPA assessment, the only exception to this general rule if if the whole of the income is from state benefits.

    The OR can not really do anything if the agreement is voluntary and the paying parent chooses not to pay, they only really assess the situation as it exists,

    BUT

    if the bankrupt was to somehow collude with the paying person in order to gain the benefit of that payment in some other way of to try and defer it until after the bankruptcy then they would be breaking the law

    so it is either not have it at all (and never recover it) for the period of the bankruptcy or do receive it and it be assessed

    as sniggings says though the IPA is based on the whole of the income and expenditue and it is perfectly possible that even with the maintanance there may be no IPA payable
